How to Hire a Real Estate Attorney

Buying or selling a house is decision that can seriously impact your financial future. When making important financial decisions such as this, I always recommend that you consult a legal professional. Some potential homeowners try to go through the process with only a real estate agent, but while a real estate agent is familiar with the process of selling and buying homes, they are not knowledgeable about real estate law. They will not be able to advise you on the legal implications of the contract you sign during the closing process. Only a real estate attorney can provide you with proper legal advice.

Therefore, when purchasing or selling at home, you should look for an experienced real estate attorney in your area. A real estate attorney can guide you through the process and help you with negotiating the best possible outcome. Remember that in a closing, your attorney, more than anyone else, is on your side and working solely for you.

Before you hire any particular real estate attorney, I suggest that you ask close friends and/or your broader community for recommendations. It is important to hire an attorney who has had good referrals in your area because familiarity with your community can be an important aspect of real estate law.

You can also look at your state’s Bar Association website for recommendations. The Bar Association should be able to provide you a list of real estate attorneys currently working in your area upon request.

Once you have a “short list” of three or four recommendations, you must narrow the list down to your final choice. One good idea is to call each attorney on your short list (or even meet them for a short consultation if you prefer). Once you get a chance to speak to your candidates, you should inquire how long they have been a practicing real estate attorney and ask them to walk you through the closing process. This will enable you to get a good sense of their professional manner and experience. A good real estate attorney can make the process of buying or selling a home a pleasant experience!
